Today, I will be delivering a talk–shared below– to Danville’s UU Congregation, addressing our legislature’s assault on trans children.

Let me begin this talk by quoting from the introduction of a recent article in the New York Times:

When the Supreme Court declared a constitutional right to same-sex marriage nearly eight years ago, social conservatives were set adrift.\

The ruling stripped them of an issue they had used to galvanize rank-and-file supporters and big donors. And it left them searching for a cause that — like opposing gay marriage — would rally the base and raise the movement’s profile on the national stage.

“We knew we needed to find an issue that the candidates were comfortable talking about,” said Terry Schilling, the president of American Principles Project, a social conservative advocacy group. “And we threw everything at the wall.”

What stuck to that wall was the issue of transgender identity, particularly that of young people. As the article went on to detail, the effort to restrict transgender rights has supplanted same-sex marriage as an animating issue for social conservatives. It has reinvigorated a network of conservative groups, increased rightwing fund-raising and set the Right’s agenda in school boards and state legislatures, including Indiana’s.

Nothing like fear of a demonized “Other” to gin up the troops….

I was asked to address the legal issues triggered by the Indiana General Assembly’s efforts to keep trans children from receiving appropriate medical care. I will do that—but before I do, I think it is critically important to point out that what we are experiencing in the U.S. right now, not just in Indiana, isn’t just an attack on the autonomy of women and the existence of trans people; it’s a political calculation that is also part of a wholesale attack by MAGA partisans on the Bill of Rights and long-settled principles of American jurisprudence.

The purpose of the Bill of Rights was—in Justice Jackson’s immortal words—”to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and establish them as legal principles to be applied by the courts.” Or, less eloquently, as I used to tell my students, the Bill of Rights answers a deceptively simple question: who decides? Who decides what book you read, what God you worship (or if you do), what politics you endorse, who you choose to marry, whether you choose to procreate…who gets to dictate what philosophers call your telos—the ultimate aims and objectives that you have chosen and that shape your life?

From 1967 to last year, America’s Courts answered that question by upholding a doctrine called substantive due process—often called the individual’s right to privacy or personal autonomy. That doctrine recognizes the existence of an intimate “zone” that governments have no right to enter— a set of personal decisions that must be left up to the individuals involved.  That doctrine, first enunciated in Griswold v. Connecticut, recognized the libertarian principle embraced by the nation’s founders.

Those who crafted America’s constituent documents were significantly influenced by the philosophy of the Enlightenment, and its then-new approach to the proper role of the state. That approach rejected notions of monarchy and the “divine right” of kings (in other words, the overwhelming authority of the state) in favor of the principle that Individuals should be free to pursue their own ends–their own life goals–so long as they did not thereby harm the person or property of someone else, and so long as they were willing to accord an equal liberty to their fellow citizens.

When I was much younger, that principle, and the importance of limiting government to areas where collective action was appropriate—keeping the state out of the decisions that individuals and families have the right to make for themselves– was a Republican article of faith. It was basic conservative doctrine. Ironically, the MAGA folks who inaccurately call themselves conservative today insist that government has the right—indeed, the duty– to invade that zone of privacy in order to impose rules reflecting their own particular beliefs and prejudices.

That process requires the use of other inaccurate labels. We’re hearing a lot about “parental rights,” for example—but we sure aren’t hearing about the rights of parents who want to treat their children’s gender dysmorphia or who want their children to have access to a wide range of books, or to be taught accurate history. In MAGA world, parental rights extend only to parents who agree with them. (A more accurate label would be “parental privileges.”)

Indiana’s legislature has now gone home, but before they left, the culture warriors who dominate that legislature passed measures doing irreparable harm to trans children. That same gerrymandered legislature was first in the nation to pass an almost complete ban on abortion after Dobbs was handed down. It was the same legislature that ignored law enforcement warnings and passed “permit-less carry,” and the same legislature that has conducted a years-long effort to destroy public education in Indiana.

I think it’s really important to understand that denying medical care to defenseless trans children isn’t a “stand-alone” position. It’s part of an entire worldview that is anti-choice, pro-gun, anti-immigration, racist, anti-Semitic and homophobic, a worldview that is autocratic and profoundly anti-American. The good news is that it’s a worldview held by a distinct minority of Americans—and that minority has gotten substantially smaller since the recent judicial and legislative assaults on women and LGBTQ+ people. The bad news, of course, is that—thanks to gerrymandering– that minority controls far too many legislative bodies, very much including Indiana’s.)

What is my evidence for the assertion that these are minority positions?

According to a Pew Research Center poll conducted in 2021, before Dobbs, 59% of Americans believed that abortion should be legal in all or most cases, while 39% believed it should be illegal in all or most cases. In a Gallup poll earlier this year—after Dobbs— 35% of Americans said abortion should be legal under anycircumstances, and another 50% said the procedure should be mostly legal, but with some restrictions. Only 13% responded that it should always be illegal. (What’s that old saying? You don’t know what you have until you lose it…)

It isn’t just abortion.

In a 2021 Gallup poll, 56% of Americans said they believe gun laws should be stricter, while 43% said they should remain as they are or be less strict.

In a Pew poll from 2021, 60% of Americans said that immigrants strengthen the country, while 37% said that they burden the country.

In another poll that year, 70% of Americans supported same-sex marriage while only 28% said it should be illegal. That level of support explains why the GOP has shifted its main focus from same-sex marriage to transgender people; the public is less familiar with transgender people, so they can more easily be demonized.

With that background, let me turn to the legal issues. On April 5th, Indiana’s ACLU– joined by the national organization– filed a 47-page complaint challenging the discriminatory and cruel anti-trans measure signed by Governor Holcomb. Let me just read the opening paragraph of that Complaint:

Over the sustained objection and concern of medical professionals, Indiana passed Indiana Senate Enrolled Act 480, effective July 1, 2023, which prohibits transgender minors from receiving what the law labels as “gender transition procedures.” These prohibited interventions are evidence-based and medically necessary medical care essential to the health and well-being of transgender minors who are suffering from gender dysphoria, a serious condition that can lead to depression, anxiety and other serious health consequences when untreated. By denying this medically necessary treatment to minors, the State of Indiana has displaced the judgment of parents, doctors, and adolescents with that of the government. In so doing, the State has intruded on the fundamental rights of parents to care for their minor children by consenting to their receipt of doctor-recommended and necessary care and treatment. This violates due process. Additionally, by singling out for prohibition the care related to “gender transition,” the law creates a facial classification based on sex and transgender status, violating the equal protection rights of transgender adolescents. It also violates their bodily integrity and is fundamentally irrational, which violates due process. And, to the extent that it prohibits the provision of essential services that would otherwise be authorized and reimbursed by Medicaid, the law violates the federal requirements of the Medicaid Act and the Affordable Care Act. It also intrudes on the First Amendment rights of doctors and other practitioners.
Speaking of intrusions on Constitutional rights, the ACLU has also filed two cases challenging Indiana’s abortion ban. The first case argues that the ban violates Indiana’s constitution. In my view, the second case is the really important challenge—it’s based upon religious liberty. Your Unitarian Church—along with several other Christian denominations, the Jewish community, and an assortment of other minority religions– has an extremely important interest in both its argument and outcome.

I’m one of many people who are convinced that abortion bans are prompted by a desire to return women to a subservient status– but those bans are publicly justified by equating a fertilized egg with a human person. As doctors will confirm, that is a religious precept, not a medical one. It’s a belief held by some Christian sects, but it is at odds with doctrinal beliefs held by other Christian denominations and by adherents of other religions. In Judaism, the health of the pregnant woman takes priority over that of the fetus throughout pregnancy, and the fetus does not have equal moral status with the mother until the head emerges from the womb.

If the Indiana Supreme Court upholds the ban, it would be favoring one part of one religion over others—a violation of the First Amendment, and ironically, a violation of Indiana’s version of the Religious Freedom Restoration Act., or RFRA. As you will all recall, that act was passed in order to justify discrimination against LGBTQ+ citizens. (What’s that saying about karma??) I’m relatively optimistic about Indiana’s Supreme Court, since none of its justices appear to be clones of Clarence Thomas or Samuel Alito.

So here we are.

MAGA Republicans are waging culture war against a fundamental premise of American governance—what Justice Brandeis once called “the right to be left alone”—a premise that animates the Bill of Rights and for the past 56 years has been protected by the explicit doctrine of substantive due process—the premise that there are decisions government doesn’t get to make.

I may disagree with your choice of religion or politics or life partner, but my disapproval is irrelevant. Even if a majority of Americans disagree with your choices, in our system, they are yours to make. Absent harm to others, government must “butt out.”

The Indiana legislature’s assaults aren’t just against women or trans people—these assaults should be seen for what they are: an effort to overturn a fundamental principle of American government.  And if that effort is successful, it won’t just be trans children who suffer. None of us will have rights that government will be obliged to respect.

Who’s Winning The War?

The title doesn’t refer to the Ukraine versus Russia war–instead, I want to talk about a far more protracted conflict: America’s culture war.

A few days ago, I shared my opinion that culture will ultimately overwhelm politics. A few days after that, a Washington Post column by Eugene Robinson highlighted a relevant University of Chicago survey of that culture. It appears–and the op-ed is titled–that “wokeness is winning.”

“Wokeness” is winning, according to an illuminating new poll that should — but probably won’t — make Republican politicians wary of hitching their wagon to the anger-fueled culture wars.

The survey — conducted this month by the nonpartisan research institute NORC at the University of Chicago, with funding from the Wall Street Journal — found that on several hot-button issues related to “wokeness”, substantial majorities of Americans believe our progress toward inclusion and diversity is on the right track.

Given the ferocity of current attacks on trans people, it was comforting to learn that 56% of respondents thought that social acceptance of people who are transgender, “has been about right” or “has not gone far enough.”  The opposing view– that we have “gone too far” in accepting transgender people–was held by 43 percent of those surveyed. 

And as Robinson noted, the results just got “more woke” from there.

On “promoting equality between men and women,” 86 percent took the woke “about right” or “not gone far enough” positions, as opposed to 12 percent who espoused the anti-woke “gone too far” view. On “accepting people who are gay, lesbian, or bisexual,” the poll found respondents to be 69 percent woke versus 29 percent anti-woke. On “businesses taking steps to promote racial and ethnic diversity,” woke beat anti-woke, 70 percent to 28 percent. And on “schools and universities taking steps to promote racial and ethnic diversity,” wokeness ruled once again, 67 percent to 30 percent.

Even on the subject of pronouns, which GOP demagogues have sought to shift from the grammatical realm to the political, 58 percent of respondents were neutral or favorable toward the practice of specifying “he/him, she/her or they/them” in emails, on social media or in conversations; 42 percent were unfavorable. And on the narrower question of “being asked” to address someone with gender-neutral pronouns such as “they/them,” those polled were evenly divided.

When the survey asked about the GOP’s current effort to ban “inappropriate” materials from the nation’s classrooms, the results were gratifying: 61 percent of respondents  were concerned that “some schools may ban books and censor topics that are educationally important.”  Only 36 percent worried that “some schools may teach books and topics that some students or their parents feel are inappropriate or offensive.”

Of course, 36% is still a troubling number, especially since these are the people most likely to be making noise and challenging educational choices. As Robinson notes, the poll results are unlikely to deter MAGA activists from “hectoring school boards to yank classics such as Nobel laureate Toni Morrison’s “Beloved” from library shelves.”

And don’t get me started about the parents who got a Florida school principal fired because a teacher in the school showed students “pornography”–aka Michelangelo’s David.

The least surprising finding of the survey was its confirmation of the partisan divide– a  divide Robinson characterized as stark.

Seventy-five percent of respondents who identified as Republicans said we have “gone too far” in accepting transgender people, as opposed to just 15 percent of Democrats and 47 percent of independent voters. Majorities of Republicans also took the “gone too far” position on gay, lesbian and bisexual acceptance, and on promoting diversity in businesses, schools and universities — versus minorities of Democrats and independents who hold those views.

As other media have reported, the one area in which the survey showed less of a partisan divide was on the issue of gun control. It found 

“broad public support for a variety of gun restrictions, including many that are supported by majorities of Republicans and gun owners….71% of Americans say gun laws should be stricter, including about half of Republicans, the vast majority of Democrats and a majority of those in gun-owning households.”

Overall, the survey confirmed what most Americans understand: American citizens’ partisan affiliations are no longer based primarily on economics or policy preferences. Instead, they reflect profoundly different values, and contending perspectives on Americanism and the common good.

The good news is that Americans who are “woke”–who value inclusion and respect for individual rights– are in the majority. The bad news is that–thanks to gerrymandering and outmoded electoral structures– MAGA Republicans and White Christian Nationalists retain far more positions of authority than they should be entitled to hold in a democratic system, given their minority status.  

The silent majority has evolved, and it’s woke. Now its members need to get out the vote.

Who’s Grooming?

The public expression of bigotry and hatred is evidently cyclical. The election of Donald Trump gave racists permission to voice sentiments that had previously been banished from polite company; that permission has since extended to an eruption of anti-Semitism and homophobia.

Until Elon Musk bought Twitter, much of that vitriol was confined online to the “dark web” and a sprinkling of small social media platforms serving communities of bigots. Musk has now invited them back, making it more difficult to avoid encountering the seamy underworld populated by these angry and hateful people.

There have always been fabrications shared among people needing to justify their prejudices–against Jews, there was the Protocols of the Elders of Zion, and a variety of blood libels. More recently, attacks against LGBTQ people have been focused on hysteria over so-called “grooming”–accusations that echo old libels about gay pedophilia.

Suddenly, drag queen story hours have been re-imagined as preludes to child sexual abuse.

Salon recently reported on an incident that reflects this effort to paint gay people and their allies as “groomers”–and the willingness of GOP politicians to jump on that bandwagon.

Rep. Ronny Jackson, R-Texas, falsely accused Rep. Katie Porter, D-Calif., of saying that “pedophilia isn’t a crime” when Porter actually said that LGBTQ people have been wrongly branded on social media as “groomers” and “pedophiles.”

The exchange between Porter and Kelley Robinson, president of the Human Rights Campaign, came during a Congressional hearing held to listen to survivors of the Club Q shooting and other activists, who testified that anti-LGBTQ violence was being encouraged by hateful right-wing rhetoric.

HRC had reported on  “the 500 most viewed, most influential tweets that identified LGBTQ people as so-called ‘groomers.'”

“The ‘groomer’ narrative is an age-old lie to position LGBTQ+ people as a threat to kids,” Porter said. “And what it does is deny them access to public spaces, it stokes fear, and can even stoke violence.”

Porter went on to ask why Twitter allows posts calling LGBTQ+ people “groomers,” since it presumably has a “hateful content” policy; Robinson responded that while community guidelines exist, platforms also need to hold users accountable to those guidelines. Twitter  clearly isn’t doing so.

“[T]his allegation of ‘groomer’ and of ‘pedophile,’ it is alleging that a person is criminal somehow, and engaged in criminal acts, merely because of their identity, their sexual orientation, their gender identity,” Porter said. “So this is clearly prohibited under Twitter’s content. Yet you found hundreds of these posts on the platform.”

If anything about HRC’s report could be considered “good news,” it was a finding that a very small group is driving this homophobic effort. The bad news is their attacks are reaching millions of people.

Just ten people drove 66% of impressions for the 500 most viewed hateful “grooming” tweets — including Gov. Ron DeSantis’s press secretary Christina Pushaw, extremist members of Congress like Rep. Marjorie Taylor Greene, R-Ga., and Lauren Boebert, R-Colo., and pro-Trump activists like “Libs of TikTok” founder Chaya Raichik.

The report found that posts from the 10 people alone reached more than 48 million views, and the top 500 most influential “grooming” tweets altogether were seen 72 million times.

In tweets by Jackson and Libs of TikTok, the exchange between Porter and Robinson was deliberately and falsely reported as Porter saying that pedophilia “isn’t a crime.”

Jackson further amplified the falsehood and tweeted: “Katie Porter just said that pedophilia isn’t a crime, she said it’s an ‘identity.’ THIS IS THE EMBODIMENT OF EVIL! The sad thing is that this woman isn’t the only VILE person pushing for pedophilia normalization. This is what progressives believe!”

As despicable as this Rightwing effort to blame the nation’s troubles on “those people”–gays, Blacks, Jews, immigrants, progressives–these attempts at misdirection aren’t new.  Would-be authoritarians, lacking any positive agenda (the GOP hasn’t even bothered to produce a party platform lately), fall back to inculcating fear and repeating a tine-tested message: if your life isn’t going the way you want it to, it’s the fault of [fill in your targeted demographic.]

Ignore us. Look at the shiny object.

Unfortunately, there really is “grooming” going on. Those campaigning to paint “the other” as dangerous, nefarious and unAmerican are the ones grooming young people and those who don’t know any better–teaching them that differences are threatening, that they are victims, and that the problems they face are never their fault or the fault of the people who look and pray like they do.

As a witness at that hearing testified, that hateful lesson–“grooming” children to become bigots– evidently requires attacking someone in a wig reading “Red Fish, Blue Fish” to a group of children at a library.

I am so tired of these people!

A Dishonest Court. A Dishonest Case.

I’ll begin with a warning: This will be a bit longer than my usual post, because I’m livid.

I began to write about 303 Creative v. Elenis, the case brought by a website designer who wants an exemption from Colorado’s civil rights/public accommodation law. She claims her “sincere religious beliefs” prevent her from “endorsing” same-sex marriages, and wants the Supreme Court to exempt her from the law’s non-discrimination requirement. She is asserting that the First Amendment–which among other things  prohibits government from compelling speech–protects “artists” and those engaged in “expressive” work from endorsing behaviors they consider sinful, and  further asserts that the act of providing a wedding website would constitute such endorsement.

Initially, I just intended to argue that framing this conflict as a Free Speech issue is dishonest.

.As David Cole pointed out in the New York Times, 

The right question is whether someone who chooses to open a business to the public should have the right to turn away gay customers simply because the service she would provide them is “expressive” or “artistic.” Should an architecture firm that believes Black families don’t deserve fancy homes be permitted to turn away Black clients because its work is “expressive”? Can a florist shop whose owner objects to Christianity refuse to serve Christians?

Cole points out that artists don’t have to open businesses in the first place.

Most writers, painters and other artists never do; they pick their subjects and leave it at that. The photographer Annie Leibovitz, for example, does not offer to take photographs of anyone who offers to pay her fee but chooses her subjects. She is perfectly free to photograph only white people or only Buddhists.

Cole also reminds us that  businesses open to the public are free to define the content of what they sell. “A Christmas store can sell only Christmas items without running afoul of public accommodations laws. It need not stock Hanukkah candles or Kwanzaa cards. But it cannot put a sign on its doors saying, “We don’t serve Jews” or “No Blacks allowed.””

The lawsuit frames a website designer as an “artist” who should be exempt from public accommodation laws because her product includes an “expressive” element. As Cole points out, multiple businesses are expressive: interior decorators, landscape architects, tattoo parlors, sign painters and beauty salons, among others.

I intended to argue that, on the ground of dishonest framing alone, the plaintiff should lose. But then I did some further research, and what I found appalled me.

I already understood that this case had been intentionally  constructed–manufactured– to appeal to our newly theocratic Supreme Court majority. The plaintiff has the same lawyer who brought the bakery case a few years ago raising the same arguments. The Court essentially “punted” on that one, returning it to Colorado without reaching the merits, and this case has clearly been manufactured to try again.

But that isn’t the half of it. Robert Hubbell provides the ugly underside.

It turns out that this case does not involve an actual “case or controversy”—as required by the Constitution.( In the United States, courts are not allowed to issue advisory opinions, only to decide actual, existing conflicts.)

In general, the jurisdiction of federal courts is limited to real disputes in which the plaintiff can show actual injury. (That is a gross oversimplification of a complicated judicial doctrine, but stick with me for a moment!)

 The 303 Creative “controversy” was manufactured by a religious advocacy organization (ADF). The plaintiff is a web design company that might—in the future—offer such services for weddings. But the plaintiff does not yet offer that service, may never do so, and (therefore) has not yet been asked to provide those services to a same-sex couple. Nonetheless, the plaintiff asks the Court for an advisory ruling about its obligations under a Colorado statute prohibiting discrimination on the basis of sexual orientation.

No same-sex couple has ever asked Smith to make them a wedding website; in fact, she has never made a wedding website for anyone. Her work to date focuses on local politicians, dog breeders, contractors, and houses of worship—not celebrations of life events.

Smith one day might be asked to make a same-sex couple’s website, ADF asserted. And when that day comes, she wants the right to say no.

The first question any lawyer–or any law student– would ask is: in the obvious absence of an actual case or controversy, why did the Court agree to hear this case? I’m afraid the answer to that is chilling: because this is a Court with a rogue, theocratic majority intent upon imposing  religious beliefs held by a minority of Americans on the rest of us–intent upon making the U.S. a “Christian nation.”

There’s more. It turns out that the Colorado statute already has language that would allow Smith to refuse to make a custom website for same-sex couples.  Only  if the business offers “off the shelf” website designs for sale to the general public would she be required to sell them to anyone who wants one. This so-called “artist” wants the Court to say that she can refuse to sell a standardized product to same-sex couples.

Let’s get real. If a business owner really, sincerely doesn’t want to work with particular customers,  it is supremely easy to evade nondiscrimination laws. The proprietor can always say something like, “Gee, Mrs. Smith, I am so backed up with orders that I can’t meet your timeline,” or “I’m so sorry, Mr. Jones, but I’m short-handed right now”…there are lots of ways these pious bigots can refrain from “participating in sin” without trumpeting their disdain or trying to change the law to encourage others to discriminate.

I will also note that the use of such all-purpose excuses would allow Smith to deny service to other “sinners”–surely her “sincere” religious beliefs would prohibit sales to adulterers or women who’ve had abortions, or atheists…interesting how these “godly” folks are laser-focused on just one sin…

It’s depressing enough to realize how many “Christian soldiers” are fixated on making life miserable for us “others.” It is absolutely terrifying to realize that the Supreme Court of the United States is controlled by theocrats intent upon eviscerating the wall of separation erected by the First Amendment’s religion clauses in order to enforce their version of “morality” on all  Americans.

Iran has morality police. How’s that working out for them?

Same-Sex Marriage Is Next

So you don’t have a uterus, and you don’t care about the Supreme Court’s decision striking down Roe v. Wade? Better hope you aren’t a member of the LGBTQ community, either–because gay folks are now in the line of fire, per Talking Points Memo.

After passing the House with the support of 47 Republicans, the Respect for Marriage Act, which would protect marriage rights for same-sex couples if the Supreme Court were to overturn its 2015 decision in Obergefell v. Hodges, faces much dimmer prospects in the Senate. There is one reason why: the Christian right still controls the Republican Party. Movement leaders know it took 50 years to reverse Roe, and are committed to a similar strategy to undermine and eventually overturn Obergefell. With abundant clues in the Supreme Court’s June decision overturning Roe that LGBTQ rights could be next on the chopping block, it is unimaginable that movement leaders would sink that goal by allowing this bill to become law.

Republican senators are keenly aware of this. That is why South Dakota’s John Thune and Louisiana’s Bill Cassidy accused Democrats of introducing the bill to distract from inflation. It is why Florida’s Marco Rubio called it “a stupid waste of time,” and claimed gay Floridians are “pissed off” about something else — high gas prices. And it is why Maine’s Susan Collins, who was one of the bill’s four original Republican supporters, came up with the laughing-crying emoji argument that, because Majority Leader Chuck Schumer (D-NY) and Sen. Joe Manchin (D-WV) had struck a surprise deal on Democratic legislative priorities late last month, she would struggle to win fellow Republicans’ support for the marriage bill. “[I]t was a very unfortunate move that destroys the many bipartisan efforts that are under way,” she told HuffPost.

The article went on to document the “avalanche of opposition” to the bill from the Christian Right that effectively controls today’s GOP.

The Family Research Council Action began calling the bill the “(Dis)Respect for Marriage Act” before it even reached the House floor, and pointed to the provision in the party’s   platform (back when the GOP still bothered with such things) that states, “[t]raditional marriage and family, based on marriage between one man and one woman, is the foundation for a free society and has for millennia been entrusted with rearing children and instilling cultural values.”

FRC Action also ginned up fear among its members by alleging that the bill would be used to persecute them and take away their religious freedom. (I remind readers that–in Christian Nationalist language, “religious freedom” is defined as freedom to impose their fundamentalist  Christianity on everyone else.)

It reminded them that in the 1970s, the IRS revoked the tax exemption of the segregationist, fundamentalist Christian Bob Jones University over its racist policies, suggesting, despite the fact that it hasn’t happened in the seven years since Obergefell, that universities and nonprofits that oppose marriage equality could face a similar fate. The American Family Association called the bill “an Orwellian attempt to pretend that the Court’s very recent discovery of a constitutional right to same-sex marriage is not controversial and offensive to many people around the country.” The Heritage Foundation called it a “publicity stunt” aimed at “tak[ing] the spotlight off progressives’ radical policies and paint conservatives as bigots — and all this conveniently before the midterm elections.”

Ever since Justice Alito’s dishonest framing in Dobbs, I have warned that his attack on the doctrine of substantive due process–the doctrine that certain matters are none of government’s business–threatens numerous rights beyond abortion. If a woman no longer has the right to choose abortion, what about choosing to use birth control? What prevents government from decreeing that same-sex marriage erodes “the foundation for a free society?”

As Talking Points Memo concluded,

It’s crucial not only to understand what Christian nationalism is as an ideology, but to understand how right-wing operatives have attained the power to subvert democratic structures and democratic values in order to make it the core of anti-majoritarian rule. The opposition to the Respect for Marriage Act is an object lesson in how that power works. Christian right operatives and lawyers argue that America is a Christian nation, that Christians’ right to practice their religion must be protected from secular, progressive incursions like constitutional rights for LGBTQ people, and that it is the duty of judges and government officials to ensure that these “biblical” values are secured. With a sympathetic majority on the Supreme Court and a razor-thin Democratic majority in the Senate with filibuster rules favorable to conservatives, the Christian right has every incentive to deploy this power. And because Republicans no longer have an alternative base upon which to build a coalition, they will continue to relent.
