Policy Versus Personality

A major benefit of the transition from Trump to Biden is that we have an opportunity to leave the politics of personality and return to boring and oh-so-welcome debates about public policy. Rather than acrimonious exchanges pitting those of us who were appalled by the buffoon and his incompetent mafia appointments against those who endorsed his assault on American values, we are gradually returning to arguments about lawmaking.

I thought about that change as I was going through some of my old teaching materials, and came across notes for my lecture on the requisites of good public policy. Since the demotion of Mitch McConnell means we may actually see policies enacted rather than stymied, I thought I’d share them.

Consider it a framework for further discussion….

The first question lawmakers must address is firmly rooted in political philosophy: does this proposal lie an area that government should control or even be involved in? Americans have very different ideas about the proper scope and authority of the state, and those ideas will affect the perceived legitimacy of any policy chosen.

One of the reasons that issues like equal civil rights for LBGTQ citizens and women’s control over their own reproduction are so salient and contested is because they begin with a profound disagreement over the legitimacy of government laws that are seen (I believe correctly)as privileging some religious beliefs over others.

This question—the right of government to decide certain matters—underlies many other policy debates. (Masks, for example.)To what extent should government dictate business practices? What areas of the economy should be left to market forces, and what services should be delivered collectively?

Disagreements about the propriety of government action are at the heart of many policy debates.

Once there is agreement that government action is appropriate, however, there are four further elements that will determine whether the policy that emerges is sound.

First, we need to agree upon both the existence and nature of the problem. Is the growing economic gap between rich and poor a problem, or simply an expected attribute of market economies? If it is problematic, why? What accounts for its growth and existence, and why and how is it damaging? Is there unacceptable racism in American policing? How do we know? If so, why has it persisted? If those making policy cannot agree that a situation or condition or existing law is a problem, and cannot agree on why it is a problem, correcting it is obviously impossible.

Second, once policymakers concur on the existence and nature of the problem, they will need to come to some agreement on the efficacy of proposed solutions. If there is agreement that the gap between rich and poor is impeding economic growth and generating social unrest, they will need to determine the probable causes of that gap, and analyze the probable consequences of the various steps being advocated to diminish it. Which “fixes” are likely to accomplish the goal? What does the available evidence suggest?Do the policymakers even agree upon the outlines of that goal, let alone the likelihood that a specific approach will accomplish it?

Third, does government have the ability to implement the solution that is chosen? Does the unit of government making the decision have the authority to impose it? Is the chosen remedy something that government can do? Would enforcement violate Constitutional principles or democratic norms?

If a proposed policy meets these standards—if there is agreement on the existence and nature of the problem, agreement on a chosen remedy, and the ability to implement it without doing violence to the country’s legal framework—a fourth necessity (and one most often ignored) arises: Are policymakers willing to evaluate the consequences of that policy? Are they willing to monitor its effectiveness and modify or reverse it if it doesn’t work, or has unanticipated negative consequences?

As I used to tell my students, Ideological, cultural and economic interests make each of these steps difficult. But difficult is not impossible–if  we elect people of good will who understand that their mission is to advance the common good.

Okay…we need to work on that last bit…

Answering Your Questions

On February 4th, I participated–via Zoom– in a panel discussion on gerrymandering sponsored by Indiana’s League of Women Voters. The program concluded with several questions still pending, and the moderator subsequently sent me the ones we hadn’t had time to address.

There were some I couldn’t answer: what is meant by a “paper trail,” for example. I rather imagine it varies depending upon the technology being employed, but I have no helpful information. And I have no data on the number of voters who found themselves moved to  new legislative districts during the last round of redistricting.

Some of the “questions” were really comments: one person bemoaned the generational effects of safe seats–the reluctance of “long in the tooth” politicians to address issues (marijuana reform, for example) that are relevant to younger voters, and another was concerned with the dominance of rural representation and the lack of genuine home rule in Indiana. A third emphasized the importance of the courts. I agree with all of them.

As for the questions: I have previously explained why the Fairness Doctrine would not be applicable to most sources of today’s disinformation. The study that found Indiana to be the fifth most gerrymandered state was conducted by scholars at the University of Chicago.  Cases challenging the constitutionality of gerrymandering have indeed been filed–and have lost at the U.S. Supreme Court.

Someone asked what incentive might appeal to both parties to end the practice, and someone else wondered how HR 1 proposed to provide that incentive, especially since states like Indiana have constitutional provisions requiring legislative line-drawing. To answer that question, I am turning the remainder of this post over to the Brennan Center.

The biggest change under H.R. 1 would be that all states would be required to use independent citizen commissions to draw congressional districts. These 15-member commissions would include five Democrats, five Republicans, and five Independents or members of smaller parties, ensuring that all interests are represented equally when lines are drawn. Strong conflict of interest rules would prevent lobbyists, staffers, and political operatives from serving on the commission, and screening processes would ensure that qualified commissioners are selected.

The process for approving a map also would be transformed. In contrast to the current practice in most states, maps could no longer be approved along party lines. Instead, for a map to become law, it would need to win support from Democrats, Republicans, Independents, and members of third parties on the commission

Partisan gerrymandering would be expressly banned

H.R. 1 would give voters an important advantage by creating the first ban against partisan gerrymandering in federal statutory law.

This statutory ban would let voters use H.R. 1 to challenge gerrymandered maps under H.R. 1 instead of having to rely, as is the case presently, on claims brought under various parts of the Constitution. Having a statutory remedy could be an especially important tool for voters given uncertainty about how far the Supreme Court will go in allowing partisan gerrymandering claims brought under the Constitution.

Importantly, the ban could be implemented for maps drawn in 2021, even the passage of H.R. 1 does not come in time for independent commissions to be set up.

Currently, the only requirement in federal law for drawing congressional districts is that states must use single-member districts. Some states impose additional requirements in their own laws, but many do not. This has created an unlevel playing field and opened the door to all kinds of manipulation.

Under H.R. 1, mapdrawers are required to avoid the unnecessary division of communities, neighborhoods, and political subdivisions. Protections for communities of color also would be strengthened to ensure that the political power of those communities is not undermined by mapdrawers.

Mapdrawers also would be required to issue written reports evaluating proposed maps’ compliance with these rules before any voting on maps could commence.

As with the ban on partisan gerrymandering, these rules could be put in place for 2021 even if passage of H.R. 1 does not come in time for implementation of commissions.

HR 1 would give the public the right to review the maps, and the right to mount an expedited challenge.

Constitutional provisions giving the legislature responsibility for redistricting can be met by having the legislature adopt the maps drawn by the commission. That provision was included in previous–unsuccessful– Indiana bills that addressed gerrymandering.

HR 1 is one of the most important measures currently pending in Congress. It would go a long way toward restoring a system that encourages, rather than discourages, voting–and an even longer way toward allowing voters to choose their representatives rather than keeping the gerrymandering that currently allows representatives to choose their voters.

McConnell And Asymmetric Polarization

I have previously made my opinion of Mitch McConnell very clear–he has been far more destructive of American constitutional governance than Trump.

America actually lucked out with Trump–a self-engrossed buffoon too incompetent, too ignorant, and too mentally-ill to do the permanent damage to which he aspired. McConnell, on the other hand, understands government and how to manipulate the arcane rules of the Senate to achieve truly evil results.

In the wake of the Georgia special election that allowed the Democrats to take control of the Senate, Jennifer Senior wrote a column for the New York Times that echoed my own reaction:

So tell me, Mitch, in these, your final hours as Senate majority leader: Were the judges and the tax cuts worth it?

Were they worth the sacking of the Capitol? The annexation of the Republican Party by the paranoiacs and the delusional? The degradation, possibly irremediable, of democracy itself?

Those close to him say that Mitch McConnell has his eye on his legacy, now more than ever. But I wonder whether he already understands, in some back bay of his brain where the gears haven’t been ground to nubs, that history will not treat him well.

Senior points out that McConnell plays the “long game,” and that he never does anything unless it serves his personal interests.

He’s methodical in his scheming, awaiting his spoils with the patience of a cat. So if hitching his wagon to a sub-literate mob boss with a fondness for white supremacists and a penchant for conspiracy theories and a sociopath’s smirking disregard for the truth meant getting those tax cuts and those conservative judges … hey, that’s the cost of doing business, right?

Suddenly, incomprehensible as it must seem to him, McConnell is being out-eviled from the right. And that reality is finally beginning to dawn on the media outlets that have aspired to “fairness” by framing contemporary politics with a patently false equivalence–ignoring the fact that the GOP has been moving to the right much, much faster (and much, much farther) than the Democrats have moved to the left, in what political scientists term “asymmetrical polarization.”

(Actually, the Democrats are simply returning to their previous position(s) after also moving right in a misconceived effort to out-Republican the GOP. See, among other things, Bill Clinton and welfare reform…)

Senior writes that, chief among the reasons for this state of affairs is  that the G.O.P. has run what she calls “a decades-long campaign to delegitimize government. Run against it long enough, and eventually you have a party that wants to burn the system to the ground.”

What really struck me about Senior’s column was her recitation of things I hadn’t previously known about McConnell–what you might call philosophical U-Turns if you are gullible enough to believe that McConnell ever genuinely embraced a moral agenda. She notes that he had “a youthful fling” with the civil rights movement, before enthusiastically embracing Nixon’s southern strategy, and that he was once pro-choice (!).

Those of us who follow public policy already knew that McConnell had joined the majority of Congressional Republicans in abandoning the GOP’s purported concern over deficits in favor of tax breaks for the rich and subsidies for favored businesses. And then…

When preserving power prerogatives overtook his party’s concerns about the former Soviet Union? No problem. McConnell refused to hear out warnings about Russian interference until weeks before the 2016 election (at which point he buried them), and he refused to consider bipartisan legislation that would attempt to curb foreign meddling until he earned himself the moniker “Moscow Mitch.”

When his party went from free trade to nativist populism, powered by xenophobia and racist resentment? Not a problem. He’d side with the populists, including their dangerous Dear Leader, until his workplace was overrun, five people were dead and the Constitution itself was among the critically injured.

Norman J. Ornstein, as usual, is analytically spot-on, describing McConnell and the radical Republicans who followed and then eclipsed him in perfidy as embracing an “ends-justify-the-means philosophy” in which winning is more important than governing.

It’s true that American politics is polarized. It is demonstrably not true that the Democrats have gone far to the left. It may look that way to the casual observer because, next to today’s semi-fascist GOP, sanity looks “left.”

We are looking through an Overton Window. It needs to shift.

Joe Biden And Childhood Poverty

Joe Biden has been President for barely a month, and he has already proved me wrong.

Don’t misunderstand–I have always really liked Biden. I have read enough stories and heard about enough incidents from people who know him personally to recognize that he is a genuinely decent, caring human being. A mensch. I was in agreement with his platform, and I was happy to vote for him. But his long history of bipartisanship in the Senate–not to mention the Obama Administration’s (constantly rebuffed) efforts to reach across the aisle–led me to expect more of the same.

Instead, Biden hasn’t just “hit the ground running.” He has been aggressive and arguably transformative. He has acted decisively to rid the federal government of the sleeper agents (my terminology, but I’d argue it’s accurate) inserted in various agencies; he’s appointed highly competent, experienced people to replace the corrupt lobbyists and know-nothings intent upon crippling those agencies, and I have applauded his clear commitment to the environment, to ending the pandemic and getting the economy back on track, among numerous other things.

While Biden has been civil and welcoming to Republicans who have made noises about compromise–Eugene Robinson of the Washington Post dubbed Biden’s recent meeting with ten GOP Senators an “exercise in performative bipartisanship”– he’s also made it very clear that he intends to fulfill his campaign promises with or without them. No more falling for what has aptly been called the GOP’s “Lucy and the football” ploys.

In other words, the good news has just kept coming!

And here’s more: I only recently became aware of an incredibly important element of Biden’s pandemic stimulus–a measure that experts say could reduce childhood poverty by fifty percent.

As Nicholas Kristof explained in his column in the New York Times, 

President Biden included a proposal in his $1.9 trillion American Rescue Plan that one study says would cut child poverty by half. We in the news media have focused on direct payments to individuals, but the historic element of Biden’s plan is its effort to slash child poverty.

“The American Rescue Plan is the most ambitious proposal to reduce child poverty ever proposed by an American president,” Jason Furman, a Harvard economist, told me.

It will not surprise anyone to know that this provision was entirely absent from the Republican “compromise” proposal. (The party of “religion and Jesus and children,” as Representative Rosa DeLauro sarcastically put it…Or as Kristof writes, “Jesus says (19:14) suffer the little children to approach him; he absolutely does not recommend that the little children shall suffer.”)

Biden’s plan to address child poverty would expand the existing child tax credit, up to $3,600 a year for young children. There is an existing child tax credit, but the way it currently works, the families that are most in need of it earn too little to take advantage of it. They earn too little to pay taxes, and the credit is taken against taxes owed. So it looks progressive–even magnanimous– but in practice, it isn’t.  

Biden’s plan would change the credit into a monthly stipend–and as Kristof notes, even a sum as modest as $3,600 would be utterly transformative for many low-income families.

One reason to think that this would be so successful is that many other countries have used similar strategies to cut child poverty by large margins. Canada’s parallel approach cut child poverty by 20 to 30 percent, depending on who’s counting, and Britain under Tony Blair cut child poverty in half.

Now that Democrats are in power, Republicans can be expected to protest that the country can’t afford Biden’s plan. (That protest conveniently overlooks the $2.3 trillion dollar cost of their massive tax cut, which primarily enriched the already affluent.) A cost-benefit analysis says we certainly can afford it, because it will ultimately save money– current estimates put the costs of child poverty to the United States at about $1 trillion annually, a sum that reflects reduced adult productivity, increased crime and higher health care costs. 

During the primaries, I worried that both Biden and Bernie were too old. I was wrong. It may be that Biden expects to be a one-term president–a realization that frees him from second-term electoral calculations, and reminds him that he has a limited time to turn the country around. 

Whatever the reason, I’ve never been so happy to be wrong. Biden is on his way to being a truly transformative president.

History May Not Repeat, But It Rhymes…

The quote with which I titled this post–history may not repeat, but it often rhymes–is attributed to Mark Twain, and it appears to be playing out in America’s increasingly bizarre politics.

It turns out, we’ve been here before, albeit without the extra “supercharging” provided by the Internet. Conspiracy theories and bigotries– and their effect on political life– are evidently as American as apple pie.

Case in point, the 19th Century Know Nothing Party. The parallels are striking.

The precipitous decline of the Know Nothings ought to concern today’s Republicans, because the resentments, conspiracy theories and rejection of reality and evidence that characterize support for Donald Trump all bear a striking resemblance to the resentments and angers that gave rise to the Know Nothings. As the linked article from Politico put it,

Much like QAnon, the Know Nothings started life as a secretive cabal convinced that the country was being controlled by an even more secretive cabal — and much like Trump-era Republicans, their anxieties were rooted in a country that seemed to be changing around them.

In the late 1840s, the United States was being flooded with immigrants, in this case from Ireland. The arrival of hundreds of thousands of poor Irish Catholics led to a rise of political groups in New York, Boston, Baltimore and Philadelphia convinced that these immigrants could form a fifth column taking direction from the Pope. Under orders from Rome, the theory went, these immigrants would undo American democracy and steal jobs from hard-working native citizens whose economic prospects were hardly secure even in the best of times.

Though these groups had actual names, such as the Order of the Star Spangled Banner, their membership at first was guarded and secretive. Asked about their views and political plans, members would reply only: “I know nothing.” The nickname was born.

The anti-immigration panic of the time coincided with the weakening and subsequent demise of the Whig Party. When the Whigs imploded, the (aptly named) Know Nothings emerged to replace them. Interestingly, the Know Nothings avoided taking sides on slavery–the issue that was genuinely tearing the country apart. Instead, it supported laws against drinking and immigration. (The anti-alcohol focus has been attributed to the stereotype of the mostly-Catholic Irish as big drinkers– a focus that gained impetus from the widespread anti-Catholic bigotry of the day.) The Know Nothings supported a wide variety of anti-immigrant measures, including laws to prevent immigrants from attaining citizenship.

These were not marginal moves. At their height, the Know Nothings, newly christened the Native American Party (long before that connoted the original inhabitants of North America), controlled the state legislatures and governorships of Massachusetts, Pennsylvania, Rhode Island, Maine and California. They also held numerous seats in state assemblies throughout the South, and they sent more than 40 representatives to the House and several senators, all adamant. Most of them supported stringent nativist, anti-immigrant legislation; all emerged from conspiratorial clubs that had spread theories about possible Papist aggression and plots against the sovereignty of the United States. (In their grotesque accusations about Catholic priests and nuns strangling babies and holding young women against their will, it’s not hard to see an early version of QAnon’s core obsession with imagined globalist pedophiles.) In 1856, the name was shortened to the American Party and its leaders nominated former president Millard Fillmore as their candidate for president under the slogan “Americans Must Rule America.”

Sound familiar?

The reason so few of us know this history is that the Know Nothing party split and declined almost as quickly as it had achieved its successes. But as the Politico article recognizes, the anti-immigrant nativism that drove its adherents never went away.

The lesson for today’s GOP is that simply being against something–or even against many things–isn’t enough. Without being for something, without being able to articulate a positive vision, growth is limited. Hate, anger and resentment can only take you so far.

Ultimately, successful politics requires addition. It requires a broadening of the base of support. The GOP’s embrace of crazy conspiracies, overt racism and self-evidently preposterous Big Lies has led instead to subtraction, as rational Republicans are increasingly exiting the party.

I think this may be where we pass the popcorn and watch the show…..
