Krugman Nails It

Paul Krugman wants to know how many of their fellow Americans Republicans are willing to kill in order to “own the libs.” In the wake of actions by Governors in  Texas and Mississippi–essentially eliminating anti-COVID requirements– it’s a fair question.

Krugman also points out–graphically–why mask edicts are not an abrogation of American freedom.

Relieving yourself in public is illegal in every state. I assume that few readers are surprised to hear this; I also assume that many readers wonder why I feel the need to bring up this distasteful subject. But bear with me: There’s a moral here, and it’s one that has disturbing implications for our nation’s future.

Although we take these restrictions for granted, they can sometimes be inconvenient, as anyone out and about after having had too many cups of coffee can attest. But the inconvenience is trivial, and the case for such rules is compelling, both in terms of protecting public health and as a way to avoid causing public offense. And as far as I know there aren’t angry political activists, let alone armed protesters, demanding the right to do their business wherever they want.

As Krugman goes on to point out, the dangerous posturing by self-described defenders of “liberty” is the essence of identity politics.  Although Republicans politicians like to accuse Democrats of playing that game, they limit the definition of “identity” to issues of race and religion–it’s their way of reminding their White Supremicist base that Democrats represent   a citizenry that includes “those people.”

What is motivating this rush to unmask isn’t economics–Krugman points out that the costs of mask-wearing are trivial, and that controlling externalities–taking into account  costs being imposed on others–is Econ 101. As he says,  “if potentially exposing those you meet to a deadly disease isn’t an “externality,” I don’t know what is.”

Of course, we know what’s actually going on here: politics. Refusing to wear a mask has become a badge of political identity, a barefaced declaration that you reject liberal values like civic responsibility and belief in science. (Those didn’t used to be liberal values, but that’s what they are in America 2021.)

This medical version of identity politics seems to trump everything, up to and including belief in the sacred rights of property owners. When organizers at the recent Conservative Political Action Conference asked attendees to wear masks — not as a matter of policy, but simply to abide by the rules of the hotel hosting the meeting — they were met by boos and cries of “Freedom!” Do people shriek about rights when they see a shop sign declaring, “No shoes, no shirt, no service”?

But arguably we shouldn’t be surprised. These days conservatives don’t seem to care about anything except identity politics, often expressed over the pettiest of issues.

There are plenty of problems with mischaracterizing mask wearing as a “freedom” issue, and one of those problems ties back into my constant rants about the country’s low levels of civic literacy.

The United States Constitution does not give anti-maskers the “liberty” they claim.

I will readily admit to being a hard-core civil libertarian.  (I ran Indiana’s ACLU for six years and was routinely criticized when our affiliate sued to protect citizens’ rights to pursue their own moral or personal ends.) But as Krugman’s introductory paragraphs illustrate, and the ACLU has always acknowledged, government retains considerable authority to require or prohibit certain behaviors. We can’t urinate (or worse) in public, or  run around our neighborhoods nude. We can be ticketed for failing to buckle our seatbelts. We can be prohibited from exposing others to the passive smoke emitted by our cigarettes. Governments not only have the right but the affirmative obligation to impose quarantines to protect public health, and they have done so historically to control the spread of diseases like smallpox.

I agree with Krugman that the anti-maskers are playing identity politics. I wonder if they realize that the identity they are claiming is “selfish and ignorant.”

Stop The World…But Then What?

Every once in a while, I come across an article or column which doesn’t convey anything particularly new or earth-shattering, but that sets out conventional wisdom in a way that makes a light-bulb come on. I had that “aha” experience when I read an opinion piece in the New York Times titled “Trumpism Has No Heirs.

The author, Jane Coaston, pointed out that–at least for the next two years–the Republican Party is ideally positioned.

As the opposition party, it will not be expected to offer solutions to the country’s myriad problems, much less introduce substantive legislation. It will not be expected to do anything except what it does best — oppose the Democratic administration and the Democratic Party.

Coaston’s observation isn’t new, of course–anyone who can spell “Mitch McConnell” or  has followed national politics even superficially over the past few years will agree that “even when holding power, movement conservatism is fundamentally an opposition movement.”

However, Coaston suggests that this “spirit of opposition” is the GOP’s Achilles’ heel –a weakness that will doom Republican efforts to “move on” from Donald Trump. Over the past few years, “conservatism” has become an empty label; as she notes, although many people  call themselves conservatives, they mostly agree about what conservatism isn’t. There is no consensus on what conservatism in the 21st Century is. And she says that Donald Trump’s candidacy and presidency exploited conservatism’s glaring lack of a central motivating vision.

The conservatism that was seemingly agreed upon by the Heritage Foundation and the American Enterprise Institute and National Review was not the conservatism that Mr. Trump sold to the American people.

Mitt Romney campaigned in 2012 on being “severely conservative” and lost. Mr. Trump campaigned on a self-serving redefinition of what it even means to be conservative and won. After all, as Mr. Trump told ABC News in early 2016, “this is called the Republican Party, it’s not called the Conservative Party.”

But what Mr. Trump was for, and what his voters supported, was not the populist nationalism generally associated with “Trumpism.” Populist nationalism has a long history in this country. Paleoconservatives like Pat Buchanan, the former Nixon assistant and political commentator, have espoused a blend of America First isolationist foreign policy rhetoric and distrust of perceived culture and political “elites” for decades.

Pundits who see Trumpism as a form of populist nationalism miss the fact that such nationalism doesn’t depend on any one individual. Trumpism does, which is why no one will pick up the “mantle.” There is no mantle, no program or philosophy of governance. Trumpism is simply the “middle finger to perceived enemies and the bulwark against real or imagined progressive assault.”

The central motivating impulse of today’s GOP is grievance and an overwhelming desire to “own the libs.” What Coaston has identified–and what I previously failed to focus on–is the essential weakness of using opposition as an organizing principle over time.

In the short term, of course,  being against something or someone generates energy and turnout. (A significant portion of the 81 million Americans who voted for Joe Biden would have voted for Daffy Duck if Daffy was running against Trump.) But for the longer term, it’s not enough.

At some point, being against everything–having no programs, no coherent political philosophy, no vision–will fail to energize enough voters to keep a party in power. That recognition is behind the formidable assault the GOP is currently mounting against voting rights.

The question is: when does disillusionment kick in? Until 2022, being against everything the Democrats want to accomplish is likely to be seen by the Republican base as a valiant effort to stop the modernity and social change that so deeply threatens them. Only if they are successful in retaking the House or Senate (or both) will citizens recognize that they have nothing positive to offer.

And by then, it might be too late.

YES!

Finally, people are seeing the connections. (And this time, I’m not talking about the extent to which America’s problems are grounded in suspicion and hatred of “the Other”–although recognition of that phenomenon has also grown.) I’m talking about civic literacy.

A recent report from the Washington Post began

It has been a bad 12 months for the practice of civics in America.
The U.S. Capitol attacked by thugs. An alleged plot to kidnap a state governor. Bogus claims of widespread election fraud. Violent protests in the streets. Death threats against public health officials. And a never-ending barrage of anger and misinformation on social media directed at, and by, politicians, leaders, pundits and an increasingly bitter and frustrated populace.

As the battles have raged, trust in institutions — government, media, the law — has plummeted.

So how did we get here? And how do we get out?

The article quotes researchers who draw a direct line from our current “civics crises” to America’s long-standing failure to teach civics. Schools do–and have done–a poor job of teaching American government, history and civic responsibility. Priority has been given to development of marketable skills and STEM education. (You can tell which subjects legislators and school systems consider important by looking at which ones are subject to  the high-stakes testing that is now widespread. Most systems do not test for civics.)

Now, a diverse collection of academics, historians, teachers, school administrators and state education leaders is proposing an overhaul of the way civics and history are taught to American K-12 students. And they’re calling for a massive investment of funds, teacher training and curriculum development to help make that happen.

The Educating for American Democracy (EAD) initiative will release a 36-page report and an accompanying 39-page road map Tuesday, laying out extensive guidance for improving and reimagining the teaching of social studies, history and civics and then implementing that over the next decade.

The “road map” attributes the extensive distrust of America’s democratic institutions to the public’s “dangerously low” civic knowledge. When it comes to understanding how America’s government is supposed to function, large majorities are functionally illiterate. The report doesn’t pull punches–it finds that neglect of civic education is a major cause of our civic and political dysfunction.

As readers of this blog know, I’ve been singing this song for the past ten years. The Center for Civic Literacy at IUPUI–which I founded–had documented both the inadequacy of American civic education and the deleterious effects of civic ignorance. (If you want to beat your head against that wall, use the blog’s search function, type in “civic literacy,” and prepare to be inundated with posts and academic papers.

it isn’t simply a matter of devoting more time to civics–it’s also a question of teaching the subject matter effectively.

The report calls for an inquiry-based approach that would focus less on memorizing dates of wars and names of presidents and more on exploring in depth the questions and developments, good and bad, that have created the America we live in today and plan to live in well beyond the nation’s 250th anniversary in 2026. What students need, the report argues, is not a laundry list of facts, but a process that produces a better understanding of how the country’s history shaped its present.

As one teacher was quoted, teaching civics has too often been like preparing students to do well in a game of Trivial Pursuit“– a list of items that you could recite on a multiple-choice test. What students need, however, is a much better understanding of how systems work and how individuals can participate in the processes of electing, debating, governing and consensus-reaching.

The new focus on educating students to become more knowledgeable citizens calls for an investment in teacher training, curriculum development and an approach that would emphasize teaching of history and civics to the same degree as STEM and English language arts courses.

It’s past time.

Horton Hears A Censor

A number of years ago, when my husband was still practicing architecture, he was presenting a school board with preliminary plans for a school they’d hired him to design. There were a number of decisions on which he wanted their feedback, but the board focused entirely–for an hour!– on arguments over the size of an elevator, and whether it should accommodate one wheelchair or two.

As he left, he ran into a friend, and explained his frustration with the school board’s focus. The friend said something I’ve thought about on multiple occasions since: “people argue about what they understand.” Insightful as that observation was, I think it needs amending to “People argue about what they think they understand.”

Which brings me to censorship, accusations of “cancel culture,” and Dr. Seuss, with a brief side trip to Mr. Potato Head.

The right wing is exercised–even hysterical–and screaming “censorship” about a decision made by the company that controls publication of the Dr. Seuss books. It will suspend publication of six of those sixty-odd books, based upon a determination that  they contain racist and insensitive imagery. The decision didn’t affect “Green Eggs and Ham,” “The Cat in the Hat,” “Horton Hears a Who” or numerous other titles.

This is not censorship, not only because they aren’t proposing to collect and destroy the numerous copies that already exist but because, in our constitutional system,  only government can censor speech. In fact, a decision by the company that owns the rights to Dr. Seuss’ books is an exercise of that company’s own free speech rights.

Think of it this way: you post something to Twitter, then think better of it and remove that post. You haven’t been censored; you made both the initial decision to post whatever it was and the subsequent decision to remove it.

Or think about that same example in the context of contemporary criticism of so-called “cancel culture.” You post something that other people find offensive. They respond by criticizing you. Your public-sector employer hasn’t punished you and, for that matter, no government entity has taken any action, but many people have expressed disdain or worse. Again–that is neither censorship nor “cancellation.”

The Free Speech clause of the First Amendment protects us from government actions that suppress the free expression of our opinions or our ability to access particular information or ideas. It doesn’t protect us from the disapproval of our fellow-citizens. It doesn’t even protect us from being sanctioned or fired by our private-sector employer, because that employer has its own First-Amendment right to ensure that messages being publicly communicated by its employees are consistent with its own.

When Walmart decides not to carry a particular book, when a local newspaper (remember those?) rejects an advertisement or refuses to print a letter to the editor, when the manufacturer of “Mr. Potato Head” decides to drop the “Mr,” those entities are exercising their First Amendment rights. They aren’t “censoring.” They aren’t even “cancelling.”

You are within your rights to disagree with the decision by those who own the Dr. Seuss catalogue (actually, that “company” is run by the author’s family, aka the Seuss estate.) Disagreement and criticism are your rights under the First Amendment. You are free to argue that the decision was misplaced, that it constituted over-reaction…whatever. But since the government did not require that decision–or participate in it– it wasn’t censorship. And unless the criticism was accompanied by ostracism–unless it was accompanied by removal of the author’s books from bookstores and libraries–it isn’t cancellation, either.

Americans have a right to freedom of expression. We have no right–constitutional or otherwise– to freedom from criticism. The desire of America’s culture warriors to “own the libs” doesn’t trump that reality.

As for the decision to stop printing and circulating six books with unfortunate portrayals, we’d do well to heed Charles Blow. In a column for the New York Times, Blow reminded readers that the images we present to young children can be highly corrosive and racially vicious.Times article on the controversy noted that  a number of other children’s books have been edited to purge what we now recognize as racist stereotypes. Often, those edits have been made by the authors who wrote the books, who belatedly recognized that they had engaged in hurtful stereotyping.

Agree or disagree with a given decision–whether by the Dr. Seuss estate or by Hasbro, the Potato Head manufacturer–it was a decision they had the right to make and a right that the rest of us have an obligation to respect, even if we disagree.

The New Civic Engagement

I know I do a lot of criticizing and complaining on this blog. But I would be remiss if I didn’t acknowledge that there are emerging signs of improvement, too.

A lack of civic knowledge and engagement is at the heart of so much that is wrong in America. It often seems that the only people who are engaged are the malcontents and bigots–the people so angry and so threatened by social change I can almost hear them screaming “stop the world, I want to push you off.”

It’s less noticeable (they aren’t organizing armed insurrections, after all) but thoughtful, civic-minded people are also engaging, and in very productive ways. Let me share two uplifting examples.

The first is a book sent to me by a reader from Encinitas, California, titled Potholes, Parks and Politics. Several years ago, Lisa Shaffer moved to Encinitas, which is a mid-sized city near Santa Barbara. She was disturbed by the incivility and “good old boy” ethos of the then city council, and she ran for and won a seat on that body when one became open. She and another Council member, Teresa Arballo Barth, subsequently decided to write a guidebook for citizens who wanted to get something done locally–but didn’t want to have to run for public office to get that something done.

Shaffer and Barth have done a fantastic job. They have anchored their guidebook in the importance of three things: civility, clarity and communication. They explain why and how to properly define the problem–it isn’t always what it seems. They also stress the importance of identifying who actually has the authority to solve a particular problem. (Sometimes, as Indianapolis folks know all too well, local government lacks that authority.)They lay out the process for contacting those authorities, making one’s case, and achieving a result, and they do it with easy to understand examples and definitions. They provide a “toolbox,” explain how local government works, define arcane terminology, provide lists of resources–and do it all in less than 100 pages, in an incredibly readable book.

The second example is closer to home, and it warms the hearts of all Hoosiers who looked longingly at what Stacey Abrams and her collaborators achieved in Georgia. It is called–appropriately–HOPE. You can access its website here.

HOPE stands for “Hoosiers Organized People Energized.”

The numbers tell the story: Indiana has two million unregistered Hoosiers. That number includes 316,000 Black, Latino, Asian-American and Indigenous citizens. It doesn’t include the 270,000 young people who will be eligible to vote for the first time in 2022.

HOPE is a 501c3 organization formed to find and register them–to expand Indiana’s electorate and increase the state’s embarrassingly low  turnout. HOPE has a partnership with vote.org, giving it expanded capabilities to verify and register Hoosiers. The organization will also work to streamline the registration process and create effective ways to ensure that previously ignored Hoosiers have a voice. The organizers have done their homework–they’ve consulted with people in several states–not just Georgia– that have effectively expanded their electorates, and they are ready to apply those measures in Indiana.

The organization has also recruited an impressive list of advisers. (I am honored to be one of them, but there is always room for more–and, of course, always a need for funding.) (Hint, hint.)You can sign up and/or donate at the website.

Expanded turnout will create a more balanced General Assembly, and enable us to send fewer embarrassing Neanderthals to Washington. I have written before that even with the Indiana GOP’s extreme gerrymandering, there would be far fewer “safe” districts if more voters cast ballots. The districts created by our gerrymandering map-makers depend upon information reflecting previous turnout. If we can turn enough non-voters into voters, we can change the results in several of them.

America is clearly at an inflection point. We have multiple problems, many of them seemingly intractable. We can either throw in the towel, give the country over to the crazy Q people and Trumpers and Christian Nationalists–or we can get involved. We can ensure that under-represented people are registered and able to vote, and we can give citizens the information and tools they need to make not just local but also state and national government responsive.

It is enormously comforting to know that these efforts are proliferating. America may be down, but we aren’t out. Yet.
