Defining “Religious Liberty”

Tomorrow, the South Bend City Council will consider amending its Human Rights Ordinance to include protections against discrimination based on sexual orientation.

HR Ordinances–while relatively toothless in Indiana–express a municipality’s intent to discourage some people from picking on other people based solely upon their religion, race, gender and other markers that are irrelevant to the question whether those people can pay the rent or perform the duties required for the job.

I’ve agreed to serve as a sort of “expert witness” at the Council hearing, and as a result, over the last week or so I’ve been copied with the various arguments being made in opposition to the proposal. As often happens when I find myself immersed in indignant justifications of homophobia, I’m increasingly feeling like an inhabitant of the Twilight Zone.

One example is the “legal memo” submitted by the Alliance Defense Fund. I’ve seen most of its arguments before–it’s pretty much a retread of similar arguments made when other Indiana cities passed similar measures. The ADF insists that Indiana municipalities lack the authority to pass such ordinances–despite the fact that over the past decade or so several have done so, and none have been challenged. The memorandum mis-characterizes court cases, and engages in the other tactics lawyers resort to when they find themselves on the losing side of a legal argument.

I understand those tactics; at one point or another, we all find ourselves desperately trying to find a legal basis for what are really policy arguments.

The jaw-dropping argument, however, and the most ridiculous claim in the entire 30+ page “brief,” is a claim that the religious exemption is inadequate because it does not protect “religiously motivated” discrimination.

Let’s think about that for a minute.

The proposal before the South Bend Council contains an exemption for religious organizations. This exemption, in my opinion, is entirely appropriate–if your religion disapproves of gay people, or unwed mothers, or atheists, the Free Exercise Clause of the First Amendment forbids government from forcing your church or other religious organization to employ such people. The law requires that we accommodate even beliefs that are at odds with basic American values.

Apparently, however, protecting the right of religious organizations to follow the dictates of their faith–even when those dictates are inconsistent with civil rights laws–isn’t sufficient. According to the ADF argument, if I truly believe gay people are sinners, that belief alone should allow me to discriminate with impunity–If I can’t fire employees I discover are gay, if I can’t refuse to rent to GLBT folks, the government is denying me religious liberty.

This is similar to the argument that anti-bullying legislation infringes the “free speech rights” of the bullies. The argument is apparently that I should be able to pick on gay people—or black people, or women, or Muslims–if I say my motivation is religious.

There’s a yiddish word for that argument: Chutzpah.

Obviously, an exemption for “religious motivation” would eviscerate the law. But this is part and parcel of the worldview of those who oppose equal civil rights for GLBT folks. Stripped of the “legalese” and rhetorical devices, that argument is simple: legislation that is inconsistent with my particular religious beliefs is a denial of my religious liberty.

The religion clauses of the First Amendment require government to be neutral between religions, and between religion and non-religion. To use a sports analogy, government is supposed to be an umpire, not a player. But there are citizens who simply cannot abide the notion of a neutral government–who experience “live and let live” and civic equality as affronts to the primacy to which they feel entitled. In that peculiar worldview, a government that insists on fair play for gay people is a government that’s denying them religious liberty.

What is it with the homophobia?

It’s one thing to believe–based upon a (highly selective) version of the bible–that gay people are immoral. You want to think that, fine. It’s a free country. As I used to say, if you don’t like gay folks, don’t invite any of them to dinner.  Your loss.

Of course, most of these religious warriors aren’t “live and let live” people. So we have weird efforts to hurt the GLBT community by passing legislation that would deny them an equal opportunity to participate in the state specialty license plate program. We are treated to the seriously hateful spectacle of legislators refusing to pass an anti-bullying bill because it might protect gay children.

And now, there seems to be a movement to roll back human rights ordinances around the country.

I find it impossible to understand the animus felt by these people. I do understand not liking someone. I understand disapproving of the policies or tactics of a group of people. I even understand that people who are uncertain of their own sexuality, or unable to deal with social changes, may feel threatened by the emergence of gays from the closet. But for the life of me, I don’t understand people who seem motivated solely by the desire to make the lives of others miserable.

On the other hand, considering just how much time and effort these “Christians” are spending on their campaign to marginalize and demean gay people, maybe they don’t have lives of their own.

Another Year (Almost) Over

The coming year is going to be ugly.

The economy is still in the toilet, environmental degradation is edging dangerously close to the point of no return, our infrastructure is crumbling, and Republicans in Congress remain committed to one thing and one thing only—defeating Barack Obama—even if they have to take the country down to do it.

Meanwhile, Larry, Moe and Curly are vying for the GOP Presidential nomination.

It isn’t easy finding things to be upbeat about in this environment, but there are some—and amazingly enough, the few bits of good news involve gay rights.

This year we’ve seen—finally—the repeal of “Don’t Ask, Don’t Tell.” More recently, the Obama Administration, represented by both Secretary of State Hillary Clinton and the President himself, put the treatment of gay citizens by their governments squarely on the human rights agenda—serving notice to governments like Uganda’s that American aid would henceforth be dependent upon their willingness to treat their gay citizens humanely. New York became the 6th state to recognize same-sex marriage. And for the first time ever, Gallup found a majority of U.S. citizens supporting such marriage. Not just civil unions—real, honest-to-god marriage.

Not a bad year on the equality front.

Perhaps the most gratifying element of this cultural shift is the diminishing salience of far-right appeals to homophobia. (One of the very few good things about an economic downturn is that it does tend to focus people’s attention on bread and butter problems rather than the hot-button, divisive social issues so beloved by the culture warriors.) A recent New York Times poll found that even among likely Republican primary voters in Iowa—one of the most conservative (dare we say batshit crazy) electorates in the country—appeals based on the old reliable “God, Guns and Gays” have lost traction.

And when “all hat, no cattle” candidate Rick Perry—desperate to reverse his falling poll numbers—made a homophobic video ad in which he decried the “attack” on Christianity signified by allowing gays in the military but not organized prayer in public schools, the ad was met with satisfying ridicule—probably not the response he was trying for.  (Hate to tell you this Rick, but that “liberty” you keep talking about includes religious liberty even for people who aren’t Christians. There’s this provision in the First Amendment called the Establishment Clause that prohibits government from imposing your religious beliefs on other people’s children in the public schools. And there’s another clause in that Constitution you clearly have never read that requires government to treat its citizens equally. Can we say “oops”?)

I’m not sure why it is that at a time of real social discord, gay citizens are finally beginning to achieve a modicum of equality. It seems counter-intuitive, but the social changes that are bringing GLBT citizens out of legal purgatory (or worse) are too obvious to deny and appear too strong to resist.

Of course, if one of the clowns running for President on the GOP ticket actually manages to defeat Obama, all bets are off—not just for the gay community, but for all the rest of us.

Priscilla–15 Years Later

We are in New York for a long weekend, and last night, my husband, son and I went to see the Broadway musical version of Priscilla, Queen of the Desert. We’d loved the movie when it came out in the early 90s…a poignant, funny depiction of life from the perspective of three Australian drag queens.

The show was full of energy–with fabulous consumes, special effects and good music. The audience clearly loved it; there was lots of laughter and a standing ovation. But it was no longer the bittersweet portrayal of nonconformity that I remembered.

The world has changed a lot in the last 15 years, and as much as I use this space to complain about our increasingly bizarre political class, our gilded age economics and our collective historical amnesia, much of that change should be applauded.

When I first saw Priscilla, a lot of people still equated “gay” with “drag queen.” And those who were drag queens were objects of scorn within what a friend of mine called the “straight” gay community. The violence encountered by the protagonists was pretty common, and the notion that each of us should be free to be whatever it is we are was not part of the culture’s messaging.

As we were walking back to my son’s apartment, we talked about the cultural shift that made Priscilla resonate so differently a mere fifteen years later. While homophobia is still present and violence not nearly as rare as it should be, we have seen a sea change–especially in cities. (Rural and small-town America is a different story, although even there, things are better.) And it isn’t just better for the GLBT community; it is better for women and other minorities. When I was growing up, all the social messages I received defined a woman’s role very narrowly; women weren’t lawyers or college professors unless they were too unattractive to find a husband, and our worth was judged largely on how successful that husband was and how well our children turned out. Most of the African-Americans I met were servants, and if I knew anyone who was Hispanic or Muslim, I was unaware of it.

I’m approaching a very big birthday, and I’ve been mulling over the challenges and lessons that come with getting old. But living a long time also gives you a perspective that isn’t available to young people. From my perspective (which is clearly not shared by a whole lot of people), the cultural shifts during my lifetime have been primarily positive.

Constructing a society that celebrates our individuality and enables personal autonomy is a good thing, even if it makes an occasional Broadway show seem like a period piece.

Supporting (some of) the Troops

As most readers of this blog probably already know, a gay soldier asked a question about gay service members at a recent GOP Presidential candidate debate, and was roundly booed by the audience. The Tea Party members who were present in large numbers in that audience—and the candidates who remained silent then and afterward—evidently saw nothing inconsistent between wrapping themselves in the Stars and Stripes and dishonoring a citizen who has put his life on the line for them.

In fact, it has been interesting to see just how far the Republican base has strayed from its previous “support the troops no matter what” posture.

Recently, Republican Representative Buck McKeon, the Chair of House Armed Services Committee, publically announced that he is willing to see the entire defense authorization bill fail if Congress refuses to pass his proposed provision preventing military chaplains from marrying same-sex military couples.

Think about that for a minute. A Republican who is the Chair of the Armed Services Committee is saying that he would hold up the funding for all our military men and women, including troops now in the field, just to keep military Chaplains from performing same-sex weddings.

Even in the wake of repeal of “Don’t Ask, Don’t Tell,” Republican Presidential candidates are insisting that they will re-instate the ban if elected. I’m waiting for a reporter—assuming we still have some of those—to ask these critics who are oh-so-picky about who can be a soldier just how they intend to fill the ranks without a draft. Enlistments are down, and it isn’t exactly a secret that recruiters have been bending the rules, taking enlistees with low IQs and felonies—but not gays, heaven forbid!—in order to make their quotas. (Somehow, I doubt that the “patriots” will step up to fill the gap themselves.)

Wasn’t it just a few years ago that the GOP talking points included accusations of treason against people who just wanted to trim some of the Pentagon’s more wasteful budget requests?

If hypocrisy smelled, we’d all be suffocating these days. The troops are “our boys” and we owe them so much—unless they’re gay, in which case we don’t even owe them constitutional equality.

It isn’t only on GLBT issues, of course—look at the reactions to the “Occupy Wall Street” demonstrators. Right-wing commentators on Fox and elsewhere are waxing positively hysterical over the chutzpah of the lefties who dare to criticize corporate greed. Current front-runner Herman Cain (the self-styled mogul who grew his pizza business into something like the 8th largest chain in the country) has characterized the demonstrators as “too lazy” to hold jobs, and “jealous” of those who have made something of themselves. Lest he be misunderstood, he’s repeatedly said that the jobless have no one to blame but themselves. (Let them eat cake…er, pizza.)

These descriptions of the “hippy” protestors might have a bit more gravitas had the same people not reacted so differently to the emergence of the Tea Party. When Tea Party “patriots” took to the streets, those who now pooh-pooh and disparage Occupy Wall Street as an unruly mob celebrated the folks in tri-corner hats as citizen activists who were taking their country back. The excesses—the hateful rhetoric, the misspelled racist signs, were conveniently overlooked or attributed to a “small fringe.”

We need to work on some new political slogans for these folks. We’ve had “Free Speech for Me, but Not for Thee.” How about “Support Our Heterosexual Troops” or “God Bless the Americans Who Agree With Me”?
